    Hearings will go on for a while. Since it is already known that the public oppose amnesty, personally I will definitely forget CIR. It may return again next year, but remember that by then the Senate may have voted out a number of incumbents that voted pro CIR.

    I think this will take patience. If one can wait and watch this unfold for the next 2-5 years without going crazy, then you may watch the passage of CIR during your lifetime.

    out of deference to the President, the republicans are not coming out publicly in opposition to it, but in private they are acknowledging anonymously that the bill is dead

    Call nearest DOL office from a public phone and with a fake identity...........
    tell them your friend is in trouble and explain the situation to them....they will guide you

    I have talked to them and they need only the name of Company and the name of victim .....rest they will do themselves.

    I understand you might not have all the documents/proofs............dont worry.........DOL knows it is a common phenomenon with such consulting company.

    Hunton Immigration and Nationality Law Blog Has Just Posted the Following:
    On July 1, 2010, the Vital Statistics Office of the Commonwealth of Puerto Rico began issuing new, more secure Puerto Rican birth certificates to US Citizens born in Puerto Rico. As of October 1, 2010, all certified copies of Puerto Rican birth certificates issued prior to July 1, 2010, will no longer be valid. Accordingly, the Citizenship and Immigration Services (USCIS) issued a press release providing guidance to US employers with regard to the I-9 process. For new employees, employers may continue to accept all Puerto Rican birth certificates through September 30, 2010; after that date, only the new Puerto Rican birth certificates (issued on or after July 1, 2010) we be acceptable for I-9 purposes. Therefore, as of October 1, 2010, employers must pay close attention to the issuance date of Puerto Rican birth certificates presented for I-9 purposes.

    For existing employees, there is no need to re-verify the employment authorization of employees who previously presented pre-July 1, 2010, Puerto Rican birth certificates. Federal Contractors subject to the Federal Acquisition Regulation E-Verify clause may continue to accept all Puerto Rican birth certificates prior to October 1, 2010, but beginning on that date, only the new Puerto Rican birth certificates issued on or after July 1, 2010, will be acceptable. Federal Contractors may not ask for the newer version during I-9 reverification of those individuals who previously presented the older version of the Puerto Rican birth certificates.

    Now that 485 is allowed till 17th what should be a strategy for H4 visa. I am sure many of us must be planning to get married earlier and get our spouse here. If she is asked during visa interview about why sudden rush to get H4 should she just say family reasons or mention the intent to file 485. H1/H4 is a dual intent visa and thus as far as I know telling visa officer the reason for sudden rush is to file 485 should not be a problem.

    But I want other peoples opinion on this. Any suggestions or does anyone see any potential problem with this scenario.

    I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.

    We are all retrogressed people here and may not have the experience in this matter. Immigrationportal.com has an area to discuss such posts. You may want to discuss there.
    In my experience in such matters, it is really not helpful to post qualifications and ask for chances of success. You need to discuss everything with an immigration lawyer since it is a highly difficult catagory for anyone. There are several finer details in each of the criterias that regular members do not know on forums.

    I think mom's in the forum can answer this better since i am sure many of them took short term disablity during delivery and subsequent months. My wife took it twice for the birth of our children and I dont think it is an issue.

    I obtained an H1B visa through Company A (starting October 2008) and the H1B visa was valid until September 2011, unfortunately in March 2009 I was laid off. As a result to maintain my status I switched from an H1B visa to a B1/B2 visa. I actually went to my home country and got the visitors visa from the consulate in my home country. In July 2009 I returned to the USA and entered the USA as a visitor on a B1/B2 visa.

    My question now is what happens if I obtain employment. What does my new employer have to do? Since my initial H1B approval is valid until September 2011, can by new employer just take over the H1B without me having to go through the lottery system again even though currently I am on a visitors visa and have been unemployed for more than 3 months?

    Hello IV Gurus,

    Below is my info and kindly let me know your thoughts

    My Current Status: H1B
    EAD start date: 1st Nov 2007 (Didnt start using it yet)
    Occupation Title: Computer Software Enginner
    OES Code: 15-1031

    New Position: Sales Consultant
    For the Sales consultant position the description is much more technical and macthes 50% with whats Computer Software Enginner.

    1. What are the immigration steps that need to be considered for the portability(AC21) ?

    2. If new corporation says we cannot do the portability because of say OES code or something else what are the options to still take the job ?

    There are two types of "scholarships": (i) taxable, and (ii) non-taxable. If the scholarship is non-taxable, which implies that it requires no work to "earn" it and it is not used for room-and-board and other living expenses, then you may be able to have that even while on H4.
