Also, people living abroad and coming here and getting citizenship is only possible as you know if they fulfill the physical presence and continuous residency requirements. Further, since they have a US address (and can provide proof for it), why should the 90 days USCIS district requirement be an issue?!

There should not be any issue for applying with only 2 months left. If you wait to get the next approval notice and go for stamping closer to the starting date of your next year of H1b you could get stamp for the next period too.
If there is 2 months or above left on the current extension then they will not give a visa including the new approval period. They will give only for the 2 months. So perferably go closer to the begining of the next period along with the new aproval notice (if you want to travel freely for the next period too)

This question is implying that the stay for the children to go to school in canada would only be a month or so, not more than six months - so does anyone know if there's a risk in messing up the green cards while the family waits a month in canada while waiting for the next destination.

I am filling form I-134 Affidivit of support for my wife and son to file their I-485 along with me.
In the Form in section 11,
That I intend /do not intend to make specific contributions to the support of the person(s) named in item 3.
(If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to furnish
room and board, state for how long and, if money, state the amount in United States dollars and state whether it is to be
given in a lump sum, weekly or monthly, or for how long.)
if I check 'I intend', what explanation I have to write for this. Please advice...

My employer has job posting Bachelor's degree with 7 years of experience but does not say anything about Masters Degree. Wanted to know this job requirement fall under EB2 or EB3?. appreciate for the response.
The advt is very sensitive. My friend lost his eb2 chance because of that.

I checked the German Mission in the US website and there I-797 is not mentioned among the documents permissible as exception for Transit Visa. Best is to call the German Mission and confirm. When I spoke to them it looked that they were already aware of this confusion and gave me a definitive answer that I didn't need the transit visa.

Once they get your response, it will be added to your case and delivered to the officer who issued the RFE. He/she will then make a decision on your case. If at that time your PD is not current, your case can not be approved even if it is approvable, but will be sent to on hold, waiting for your PD to be current.

Here is something we really should watch closely. US senate race in Massachusetts between Democrat Coakley and Republican Brown. They are fighting for the vacant seat of Hon. Late Senator Ted Kennedy. Now, people would think, why a race in mass. matter? It's a completely blue state, and had no republican senator in last 40 yrs, obviously a democrat would win. The election is on tuesday and the ground reality seems to suggest something else.
This seat is crucial for President and Democrats as it is the much coveted 60th seat in the senate to get a filabuster-proof majority which democrats have enjoyed so far. It is critical for healthcare reform as well as for immigration reform (if at all it comes).
The gap between both the candidates was narrow with democrat leading but today, for the first time, polls indicate that Brown has taken lead over Coakley. People in this blue state seem to increasingly support Brown, mainly frustrated because of healthcare policies. Mass residents already have a healthcare related tax to help run state's universal health care. On top of that, federal health overall would be adding more taxes on people and people fear that they will end paying both. Already, mass is a very high tax state. not sure about I-140, i think it should be ok to mention your spouse name but check with your immigration lawyer about this.
NOTE: as far as i know, if your wife is in H4 visa, you can file her AOS (I-485) as your spouse. But if she is in F1 visa, you CANNOT file her I-485 as your dependent along with your I-485 since she is in F1 student visa. but check with your immigration lawyer about this..

My mom is scheduled for an interview for a visitor visa at US Consulate, Chennai. My mom is 70 years old and she will be the only person attending for the interview. She has not travelled a lot and she will not be able to figure out everything that is needed inside the consulate before and after the interview by herself. Now - my question is - Can my mom take anyone (say a relative) with her inside the consulate for help?

No, she cannot carry anyone else except herself inside the consulate. A relative can accompany her till she enters the consulate and your mother can ask for a translator and I am sure there would be people to help her, otherwise too.
