My Personal experience was:
- When my H1B was filed for the first time it had a wrong Date of Birth, lawyer asked me to bring Birth Certificate to the Interview at the consulate. I did not have problems with the stamping of the visa.
When my extension was filed , again, Date of Birth was wrong. Lawyer told me the same thing. Get recent Birth Certificate and bring it to the Interview.
Did not have any problem at all.

Please do not rely on Indian Media for immigration news.
They have covered their bases by putting "May" in the headline. "May" increase visas.
There is already a discussion that happened about this on another thread. Please search the forums for the article before starting a new thread.
And for heaven's sake, please dont look for immigration related news in Indian Newspapers. They dont know that congress has two chambers : House and Senate. And they dont know the common basics of legislative process in USA.

From what I have heard from close friends/relatives, your option B is correct.
Also, people living abroad and coming here and getting citizenship is only possible as you know if they fulfill the physical presence and continuous residency requirements. Further, since they have a US address (and can provide proof for it), why should the 90 days USCIS district requirement be an issue?!

HR of my Company screwed up with the content of the EB2 Ad posted in sunday newspaper. To save money they posted a partial AD with a link to the job listing on the companys website saying "Please goto this link for further information".....
Would this be ok?
If the company is paying the lawyer for the process, you just relax. They must have consulted the lawer before giving the ad and get directions, because the lawyer has to send these evidences when filing.
If not, you better check with an expert.

I have a question. I have a student visa now from last 4 years and before these student visa I started a small business in India. i didnt expected it to grow much but now it has grown. I have used money from that business for my 2nd MS which is not completed yet
Here is the problem
I am getting married in May. Till May I can stay here legally but than once I leave and get married I want to come with my Wife. So I have 3 options
She apply alone for visitor visa ( chances are less for these)
She come as dependent ( I dont have any income here or any source of income from college)
I leave my student visa and we both apply for visitor visa. These option has a lot of risk but its the best I am thinking as I am not interested in going to college anymore
What you think which route I should take?

2) can she do any thing about medical exam in India. I mean can she get a certificate from India?
They may not accept a certificate from india, medical exams has to be done by a civil surgeon in your area who is authorized to perform the tests.

Yes it seems USCIS is also asking the public to help improve its website. It has posted a link on its homepage "Help improve uscis.gov" which was supposed to take you to another page. Unfortunately that link is broken as of now. If you click on it, it takes you to a blank page.

Some of the big names like fragomen etc seem to handle mostly company cases and are too expensive for individual case filing.
Also how much is the charge typically for the whole GC process or PERM. I know it would vary depending on lawyers but i am looking to get some general idea on how much people on the Forum have spent filing their cases from GOOD lawyers.
I am going thru Indu Law Firm.. She / Her Assistances are well orgnized (firm)

I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.

Compare the job duties (not just job titles) of the original and new job to determine if they are in the same Standard Occupational Classification (SOC). See, Find Occupations (http://online.onetcenter.org/find/). If the jobs are in the same SOC, they would both have the same prevailing wage and no material change has occurred. In that case, you may only need to get a new LCA. All LCAs take up to 7 business days to get certified by the DOL. This appears to be more relavant given the need for rejuvenating the state chapters. Why not we have this as simple links on the main page itself and make it damn easy to join the chapter. The most important thing to do is to have the members join the chapters and have the contact numbers. Once these are there the IV state chapters could follow up and get the activities rolling with these members.
Bottom line: Have the state chapter joining links on the main page and have it simplified for the members to join very easily ( kind of taking the name, contact number and email and nothing more) later the chapter core could get in touch with them and get the complete profile. A kind of marketing gimmick.

Company B applied H1B tranfer petition for me two weeks back. Our documents went to USCIS, and we didnt received receipt notice yet. To my surprise the filing fee check is also not yet encashed.
Can anyone of you please let me know, if I can start working with company B now or wait until we get the receipt notice. What is the USCIS guidelines with the start date during H1B transfer.
